Can someone settle an arguement for me please ??

Is import duty payable on items purchased in Germany ??

it shouldnt be on most items.
However some are still subject to local taxes, ie booze and fags after a certon amount.

Don't think so, not if you pay the duty in Germany. For example, if you pay the German VAT , then you don't pay British VAT.

It's for car parts off of ebay.
I know the score for the rest of the world, but a mate is insisting duty will be payable on them :? :?

From 19 July 2007, excise duty is due on all excise goods (including tobacco and alcohol products) received via post from abroad, including occasional gifts and goods ordered online. This applies to goods sent from EU and non-EU countries. Please see the Government Press release.

Customs duty is not payable on goods bought from countries within the EU. However, VAT is payable (if due) either in the EU country of purchase, or in the UK if the EU supplier is UK VAT registered. But, special rules apply to excise goods ie cigarettes, tobacco alcohol etc and these are explained separately.

Import duty is only payable on certain products that are purchesed outside of the EU. If the trade take's place between 2 EU countries, then the products are duty free.

However, VAT can be payable on goods that are being purchesed from within the EU and brought into the country, same as out side of the EU.

So in summary, import duty is only payable on certain items purchased from outside of the EU and VAT is payable on everything.

The above guidelines form the HMRC are very very iffy. I have been working within the industry for 7.5 years and duty is NOT payable on goods that are being traded betwen EU countries, but VAT can be.

VAT paid in any EU country should mean VAT free elsewhere.

For example, we can buy an aeroplane from Austria (non-EU) through an agent in Denmark and pay Danish VAT. Then we can import it to the UK VAT free as EU VAT has already been paid. There is no import duty as it's a trade within the EU.

The Danish VAT rate is lower so it's worth doing.

Second hand goods should be VAT and duty free if EU taxes were paid originally.

If the seller is VAT registered within the EU, then VAT is still payable on the goods whether they are secondhand or new
